On Python 3.9, Popen passes encoding=None, not "locale", to
TextIOWrapper, so simulated_cp1252 changed nothing and the encoding
regressions could not catch a missing encoding="utf-8". The stdout
newline test used Path.write_text(newline=...), which needs 3.10.

command_output patched subprocess._text_encoding, which does not exist on Python 3.10, so all eight tests errored before their assertions. Use subprocess._text_encoding where available and map io.TextIOWrapper locale to cp1252 on older interpreters, so a subprocess with no explicit encoding decodes as cp1252 on both. Add a behavioral check that default decodes as cp1252 while explicit utf-8 stays correct.

One PR diff containing a byte that is not valid UTF-8 made git() and
merge() raise, which aborted the hourly run and dropped the overlap
comment on every PR. Both subprocess calls now pass errors="replace",
matching check_conventions.py. A test commits a Latin-1 byte and checks
the export is still found.
