The unattended helper restore pushed the helper as soon as :9021 answered, which on a cold boot is before kstuff loads (FW 11.40 report: crash 3/3). It now waits 90 s after the loader first appears. # Disclaimer and Terms of Use
|

**Please read this before using ps5upload.**
|
|
|
|
## 1. Research and educational purpose only
|
|
|
|
ps5upload ("the Software") is provided solely for **research,
|
|
educational, interoperability, and homebrew development purposes**. It
|
|
is intended for use by developers, security researchers, and hobbyists
|
|
studying the architecture and behaviour of console systems they
|
|
personally own.
|
|
|
|
The Software is **not** a commercial product, is **not** affiliated
|
|
with, endorsed by, sponsored by, or in any way officially connected to
|
|
Sony Interactive Entertainment Inc., Sony Group Corporation, or any of
|
|
their subsidiaries or affiliates. "PlayStation", "PS4", "PS5", and all
|
|
related marks are trademarks of Sony Interactive Entertainment Inc.,
|
|
used here only for identification and descriptive purposes under
|
|
nominative fair use.
|
|
|
|
## 2. Modified consoles
|
|
|
|
The Software is designed to communicate with consoles running
|
|
user-supplied code ("jailbroken", "modified", or "homebrew-enabled"
|
|
consoles). **You are solely responsible** for the legality of modifying
|
|
your device in your jurisdiction, and for obtaining and running any
|
|
such modification. The Software does not provide, enable, distribute,
|
|
or assist in obtaining any exploit, jailbreak, or method of
|
|
circumventing technological protection measures.
|
|
|
|
## 3. No warranty
|
|
|
|
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS
|
|
OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
|
|
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
|
|
NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE
|
|
LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION
|
|
OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION
|
|
WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

## 4. Assumption of risk
|
|
|
|
Operating a modified console and running low-level code against it
|
|
carries real and material risk. These risks include, without
|
|
limitation:
|
|
|
|
- **permanent, unrecoverable damage to your console** ("bricking");
|
|
- **irreversible loss of saved games, screenshots, captures, licences,
|
|
and other data**;
|
|
- **system instability, crashes, forced restarts, and data corruption**;
|
|
- **suspension or permanent ban of your account and/or console** from
|
|
online services;
|
|
- **voiding of your manufacturer warranty**.
|
|
|
|
**You use the Software entirely at your own risk and accept full and
|
|
sole responsibility for all consequences of doing so.** By using the
|
|
Software you acknowledge that you understand these risks and accept
|
|
them. If you are not willing to lose your console, your data, and your
|
|
account access, do not use the Software.
|
|
|
|
**Back up anything you cannot afford to lose, before you begin.**
|
|
|
|
## 5. No piracy
|
|
|
|
The Software must **not** be used to copy, distribute, download,
|
|
install, or run any software, game, or content that you do not lawfully
|
|
own or are not lawfully licensed to use. Circumventing copy protection
|
|
for the purpose of infringing copyright is illegal in most
|
|
jurisdictions.
|
|
|
|
The authors do not condone, support, or provide assistance with piracy
|
|
in any form. Requests for such assistance will be refused. Using the
|
|
Software for infringing purposes is a violation of these terms and is
|
|
entirely the responsibility of the user who does so.
|
|
|
|
## 6. Your responsibility
|
|
|
|
By downloading, building, installing, or using the Software, you
|
|
represent and warrant that:
|
|
|
|
1. you own, or are otherwise fully authorised to modify and operate,
|
|
any device you use the Software with;
|
|
2. you will comply with all laws, regulations, and contractual terms
|
|
applicable to you, including any terms of service you have agreed to
|
|
with the device manufacturer or platform operator;
|
|
3. you accept sole and complete responsibility for all actions you take
|
|
using the Software and for all resulting consequences; and
|
|
4. you will not hold the authors, contributors, or distributors of the
|
|
Software liable for any loss or damage of any kind.

|
|

## 7. Indemnity
|
|
|
|
You agree to indemnify, defend, and hold harmless the authors,
|
|
contributors, and distributors of the Software from and against any
|
|
claims, liabilities, damages, losses, and expenses, including
|
|
reasonable legal fees, arising out of or in any way connected with your
|
|
use or misuse of the Software or your violation of these terms.
|
|
|
|
## 8. Development process
|
|
|
|
The Software is developed with AI coding tools ("vibe-coded"), directed
|
|
and tested by its maintainer. This is a deliberate choice to keep a fast
|
|
development cycle and a short turnaround on bug reports, feature
|
|
requests and enhancements. It also means the code has not received the
|
|
extended, line-by-line human review that a conventionally written
|
|
project of comparable size would. Releases are tested on real consoles
|
|
before publication, but defects may remain. You accept the Software on
|
|
that basis and use it at your own discretion.
|
|
|
|
## 9. Severability and governing terms
|
|
|
|
If any provision of this disclaimer is held to be unenforceable or
|
|
invalid, that provision shall be limited or eliminated to the minimum
|
|
extent necessary so that the remainder of this disclaimer remains in
|
|
full force and effect.
|
|
|
|
This disclaimer supplements, and does not replace, the terms of the
|
|
GNU General Public License v3.0 under which the Software is
|
|
distributed. See [LICENSE](LICENSE). Where this disclaimer and the
|
|
licence differ on warranty and liability, the broader exclusion
|
|
applies to the maximum extent permitted by applicable law.
|
|
|
|
## 10. If you do not agree
|
|
|
|
If you do not agree with any part of this disclaimer, **do not
|
|
download, build, install, or use the Software**, and delete any copy in
|
|
your possession.
